We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

3. User Responsibilities

7. SMS Terms of Service

7.5 Supported Carriers

Our SMS service is available on major U.S. carriers, including but not limited to AT&T, Verizon, T-Mobile, and Sprint. Not all carriers or devices may be supported.

7.6 Privacy

Your mobile number and related data will be handled in accordance with our Privacy Policy (see Section 11). We will not share your mobile number with third parties for their marketing purposes without your consent.

8. Termination

We may suspend or terminate your access to the Services at our discretion, with or without cause, including for violations of these Terms. Upon termination, your account and right to use the Services will cease immediately. Sections 5, 6, 9, 10, 11, 13, and 14 will survive termination.

9. Limitation of Liability

To the fullest extent permitted by law, Opsgrow and its affiliates, officers, directors, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us for the Services in the preceding 12 months.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services will be resolved through binding arbitration in Delaware, conducted under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

You agree to indemnify and hold Opsgrow harmless from any claims, losses, or damages, including reasonable attorneys’ fees, arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
